Both the Federal and State constitutions allow the government to take an individual’s property when it is deemed to be in the interest of the public, this is commonly known as the “Right of Eminent Domain”. In Louisiana, the taking is referred to as an “Expropriation”. The most common takings are for projects like roadways, levees and public utilities.

The same laws that give the State the right to take property also require it to pay “Just Compensation” for what it takes. “Just Compensation” is the “Market Value” of the property taken plus any damages and expenses related to the taking. Determining “Just Compensation” can be very complex. Takings may be for the whole ownership, part of the property or just certain rights. Appraising for “Just Compensation” requires differing assumptions and rules depending on the type and purpose of the taking.
